In Bulgaria, a design refers to the appearance of the whole or a part of a product resulting from the features of, in particular, the lines, contours, colors, shape, texture, or its ornamentation. The design registration process in Bulgaria begins with the submission of an application to the Bulgarian Patent Office (BPO). The application must include representations of the design and details of the applicant. Upon receipt, the BPO conducts a formal examination to ensure all requirements are met. This examination checks for completeness of the application, including whether the required documents are attached and whether the applicant has paid the necessary fees.

 

If the application passes this stage, it undergoes a examination for substantive requirements, namely whether the declared design is consider to be design under the law’s definition and is not excluded from protection, the images of the design are also carefully examined in view of the stringent image requirements. No search is made of the prior art to determine whether the substantive criterion of novelty and originality are satisfied by the design for which registration is sought. Generally speaking, the burden of assessing novelty and originality is shifted to those interested persons in the market who may wish to use, or who may have used, the design or a substantially similar design. Such interested partie may challenge the validity of the design, based on novelty and originality, in a post-registration invalidation proceedings if interested. 

 

Once the examination is complete and the design is found to meet the requirements, the BPO proceeds with the registration of the design.The registration is published in the official bulletin, making it accessible to the public. It usually takes around 1 months for non-deficient applications to get registered. The registered design is then valid for an initial period of ten years, with the possibility of renewal for further 3 periods of five years, up to a maximum of 25 years.

When applying to register a design in Bulgaria, certain documents are necessary. These typically include:

 

  • A completed application form providing details of the applicant, designer and the design
  • Representations of the design, which may include drawings, photographs, or other visual depictions up to 7 images per design
  • Details of the applicant(s) and designer(s), including their name, address, and contact information
  • Power of attorney, if the application is being filed through a representative or agent
  • Priority documents, if the applicant is claiming priority from an earlier application

 

These documents are essential for the BPO to process the application and determine the eligibility of the design for registration.

5. Design Opposition Process in Bulgaria


As soon as the design is registered, any person or entity interested in using such a design will have the opportunity of bringing proceedings for the cancellation of the registration which has been alleged as invalid. Grounds for invalidation may include prior rights, lack of novelty and/or originality respectively, or the design not meeting the criteria for registration as outline above. The BPO examines the invalidation application and may either reject it or invalidate the registration if deemed necessary. This invalidation process provides an opportunity for third parties to remove the registration of the design from the register and protects the interests of existing rights holders as well to any commercial operator that believes the design is not new and original.
